  1. PRIMERO. DEJAR SIN EFECTOS el auto del 21 de mayo de 2026, proferido por el Juzgado 006 Penal del Circuito Especializado de Bogot�, mediante el cual declar� su falta de competencia para conocer de la acci�n de tutela promovida por el se�or Roberto D�az Gil contra el Fondo de Pasivo Social de Ferrocarriles Nacionales de Colombia.
  2. SEGUNDO. REMITIR al Juzgado 006 Penal del Circuito Especializado de Bogot� el expediente ICC-5433 para que, de manera inmediata, tramite y adopte la decisi�n a que haya lugar.
  3. TERCERO. Por intermedio de la Secretar�a General de la Corte Constitucional, COMUNICAR la presente decisi�n al accionante, al Juzgado 006 Penal del Circuito Especializado de Bogot� y al Juzgado 001 Administrativo Oral del Circuito de Bucaramanga. Notif�quese, comun�quese y c�mplase.
